They are typically used as evidence in a civil case to prove certain facts, such as: ownership, provision, or possession of a product, service, or activity. Pleading possession and/or use is required in a criminal matter in order to have those documents used as evidence in a case. But, they can also be used as legal testimony in a criminal proceeding, so it's always a good idea to document those documents.Pursuit papers are very similar to summonses. The process is exactly the same, except that in addition to being a legal document, they must be personally served on the party whose activities are under investigation. To qualify as a summons, the document must contain the judgment, demand, or order of the court. To qualify as a judgment, the document must state that the party is subject to the judgment and that the party is being sued in a certain action. The action can be a civil proceeding, a criminal proceeding, or a non-criminal proceeding.Pursuant to the act, a judgment must be obtained if the party's actions indicate probable negligence or fraud. It can be used to obtain money damages, such as for negligence, malicious prosecution, a breach of a duty of care, wrongful death, or any other act that results in monetary damages. It can also be used to obtain restitution or compensate victims, including for injuries sustained, emotional distress, mental anguish, or loss of a property.A demand must be issued to the party who owes the monetary damage, as well as any agents of the party who may have caused the damage. This includes a third party who may have provided goods or services to the party.A summons can be issued in conjunction with an action in an administrative or court proceeding, which means that it may be issued for the purpose of securing evidence or to obtain testimony by a witness at trial. It may also be issued to obtain information from a third party or a person other than the defendant, but it can only be issued to obtain one form of information, such as financial records, inventory, invoices, or a certificate of compliance.Pursuit papers may also be issued as a way to collect fines, penalties, or interest due. In a court proceeding, a judgment may be obtained to recover the actual costs or fees associated with litigating the case, including fees for outside counsel, expert witnesses, and other related expenses.In a civil proceeding, a judgment may be obtained to obtain the right to pursue the defendant in the same manner as in a criminal proceeding. But, in a criminal case, the judgment can only be obtained for compensatory damages. In a non-criminal proceeding, a judgment can only be obtained for punitive damages.For a valid civil action , a judgment must be obtained from a court to provide a means for recovery of compensatory damages and punitive damages. Pursuant to the Florida Fraudulent Business Practices Act, a judgment obtained from a court must be enforceable in a court of equity.
